Jackson doc won't be asked to pay restitution
By ANTHONY McCARTNEY, AP Entertainment Writer – 13 hours ago
LOS ANGELES (AP) — Prosecutors will not seek restitution against the doctor convicted of killing Michael Jackson after conferring with the singer's parents and attorneys for his estate and children.
The request for payments from Conrad Murray was withdrawn Wednesday during a brief court hearing, just days before a judge was scheduled to consider how much the former cardiologist should pay to members of Jackson's family or his estate.
Deputy District Attorney David Walgren told the judge handling the case that he was withdrawing the restitution request after speaking with Jackson's mother, Katherine, and attorney for his father, Joseph. Walgren also consulted with an attorney for the singer's estate and a court-appointed attorney representing the interests of Jackson's three children, a transcript of the proceedings shows.
Murray remains in jail after being convicted in November of involuntary manslaughter. He was sentenced to serve four years in jail, but his incarceration will be cut in half due to overcrowding and California's budget crunch.
Jackson's estate estimated the singer would have earned at least $100 million if he had performed his "This Is It" concerts planned for London's O2 arena. Murray might have also been found liable for Jackson's funeral expenses, which totaled more than $1.8 million. Murray's attorneys said he had nowhere near the money to pay either amount, and he filed paperwork last month indicating he is indigent.
Superior Court Judge Michael Pastor ruled that the family was waiving its right to restitution permanently, although two separate cases pending in a Los Angeles civil court seek damages for the King of Pop's June 2009 death. Katherine Jackson is suing concert giant AEG Live, which was promoting Jackson's planned series of comeback concerts, claiming they failed to properly supervise Murray.
Joseph Jackson is suing AEG Live, alleging negligence by the entertainment promoter in his son's death, and he is suing Murray for wrongful death in the case.
Murray's attorney, J. Michael Flanagan, said he was pleased to have the restitution issue resolved. Flanagan said during Wednesday's hearing that he intends to seek bail for Murray while he appeals his conviction, according to the transcript, but he was told to put the request in writing.
The fate of Joseph Jackson's civil case remains unclear. A California bar court in Los Angeles recommended Friday that the Jackson family patriarch's attorney, Brian Oxman, be barred from practicing law because of conduct on other, unrelated cases. Oxman filed Joseph Jackson's lawsuit in federal court on the one-year anniversary of the singer's death, but a judge later ruled it should be heard in state court. Oxman is the only attorney who has been listed on the case so far and has been a vocal antagonist against Murray and AEG Live.
Reached by phone, Oxman declined to comment on the recommendation, which still must be approved by the California Supreme Court.
The disciplinary court found that Oxman and his wife, who is also his law partner, mixed clients' and personal funds in an effort to evade creditors and sanctions imposed against Oxman. He had been disciplined previously, which the court cited among its reasons for seeking the revocation of his law license.

Hi All,

Thank you for the great information Bonnie, and everyone.

The above article concerning Murray’s release from Jail while his appeal is pending prompted me to do a Google search to find the public opinion on this.

I think releasing him would be an abomination of the justice system. Michael does not get to live with his kids, or have any of the pleasures that Conrad Murray would have while out of jail and living with his girlfriend. Murray would be free to make more children when he can’t afford to support the ones he has.

The Jackson family is upset enough because of the little time Conrad Murray is getting:

Please give your public opinion and vote on the website below. Conrad Murray should get the Max sentence, yes or no. It’s a start.

Bonnie, is their anywhere we could write to give our opinion? Do you feel writing to someone would help the prosecution or would help to persuade the judge?

Nothing of what has been transpiring in relationship to this case can surprise one any more.
Now Murray wants lenience in light of having been a participant in the murder of an innocent man and getting a by-all-standards light sentence.
So he wants the judge to feel sorry for his difficult circumstances. Hmmm... Interesting. What sheer arrogance.
Seems to be a common trait among all involved in ensuring Michael's demise.

Hi Irina,

Hope you are doing well Irina. I agree with your level of disgust.

Murray is asking to be released on NO BAIL pending the appeal because his lawyer says he is running out of money(see url below).

It blows me over to think Murray is also seeking employment. He says to support his children -- though it's unclear what work that would entail ... considering his medical license has been unceremoniously revoked.

I think he should be saying; I deserve 4 years in jail for what I took away from Michael, but instead Murray is acting as though he did nothing and he is the one that is wronged. He sounds dangerous to me. He is in complete denial concerning his roll in Michael's death.

Love,

Mar

Hi All,
Finely Michael Jackson's doctor is barred from practicing in Texas.

Here is the website:

http://www.chron.com/news/houston-texas/article/Michael-Jackson-s-doctor-barred-from-practicing-3306592.php#photo-1814362

"The Texas Medical Board Friday suspended Murray's license, nearly three years after the death of the pop singer. Murray, currently serving a four-year jail sentence, administered an overdose of the anesthetic propofol that killed Jackson in June 2009."

"This achieves the same effect as license revocation," said Leigh Hopper, board spokeswoman.

"Murray is currently asking a California judge to release him from jail pending appeal of the case. His lawyer said Murray knows he cannot work as a doctor but would find other employment in California to help support his seven children, according to the Associated Press. A hearing on the motion is set for Feb. 24."

My personal feelings gravitate toward leaving him in jail for the whole 4 years. But I suppose that is too much to ask. :(

Really they should lock Murry up and throw away the key... because that is what is happening to Michael's kids, family, friends and fans. We were robbed for a lifetime. We can never see or experience anything with Michael EVER!

Keep posting everyone. I'm listening, even when I'm not participating.

Love,

Mar

Hi Everyone!

Thank you for the updated information Bonnie. I'm glad they are keeping Murray behind bars.

Hi Irina,

Thank you for the thought provoking question. I'll add my two cents. :)

I think the reason Murray is on Solitary confinement revolves around his safety. Two things cross my mind in contemplating reasons for putting Murray in solitary.

1) To keep him from harming/killing himself. The world knows what he did and that has to weigh heavily on him.
Example: "Conrad Murray on suicide watch in solitary confinement":

http://features.rr.com/article/0ea9bSC6hieQL?q=Michael+Pastor

2) There could be prisoners that are in the same prison as Murray that would love to get their hands on him. There are a lot of people in prison that "Love" Michael Jackson and since these prisoners are in prison for life, what is one more death?

In other words, there would be no consequences for someone in jail on a murder conviction to oust Murray. They could already be sentenced to life or legal injection.

That is my opinion and the only thing that makes sense to me.

I don't think prisoners in solitary usually get visitors, but Murray does. See article below:

"Michael Jackson doctor Conrad Murray gets a prison visit from girlfriend Nicole and mother Milta."

Lots of Love sent your way,
